These Terms of Service (“Terms,” “Agreement”) apply to your access to and use of watchfulexterminators.us, including pages, content, forms, and related features (collectively, the “Website”). The Website is operated by Watchful Exterminators (“Watchful Exterminators,” “we,” “us,” or “our”) from Arlington, Virginia.
By accessing, browsing, or using the Website, you agree to these Terms and our Privacy Policy. If you do not agree, do not access or use the Website. You represent that you are legally able to enter into this Agreement and, if you use the Website for an organization, that you have authority to bind that organization.
2. Nature of the Website
The Website provides general information about pest-control topics and may help homeowners, property managers, and other visitors contact Watchful Exterminators or connect with independent local service contractors. Information on the Website is not a substitute for an on-site inspection, a written service agreement, professional advice, or emergency assistance.
Any contractor or service provider you contact or hire is independent from Watchful Exterminators unless a separate written agreement says otherwise. You are responsible for evaluating a contractor, confirming its identity and qualifications, understanding the proposed scope of work, and entering into any service agreement directly with that contractor.
3. Limited Use License
Subject to these Terms, Watchful Exterminators grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Website for personal, lawful, non-commercial purposes. This license does not transfer ownership of any content or intellectual-property rights to you.
You may not copy, reproduce, republish, distribute, sell, rent, lease, license, modify, create derivative works from, publicly display, frame, mirror, scrape, reverse engineer, decompile, or exploit the Website or its content except with our prior written permission or as allowed by law. You may not use the Website to build a competing website, database, or service.
4. User Obligations

When you check a TCPA consent box or otherwise request contact, you authorize Watchful Exterminators and, where applicable, an independent contractor or service partner receiving your request to contact you about that request. Consent is not a condition of purchasing a service. Message and data rates may apply.
You may opt out of promotional text messages by replying STOP and may request assistance by replying HELP. You agree to update us if the number you supplied is reassigned, deactivated, or no longer controlled by you. We are not responsible for messages sent to a number you provided if you did not update us about a change.
6. Disclaimers
THE WEBSITE AND ITS CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS TO THE MAXIMUM EXTENT PERMITTED BY LAW. WATCHFUL EXTERMINATORS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND RELIABILITY.
We do not promise that the Website will be uninterrupted, error-free, secure, current, or free of harmful components. We do not warrant the quality, safety, legality, availability, pricing, timing, licensing, insurance, or performance of any independent contractor or service provider. You are responsible for verifying the contractor’s information and the terms of any work you authorize.
General Website information may not apply to your property, pest, building, or local requirements. Do not rely on a Website page as the sole basis for a safety, health, construction, legal, or financial decision. If you believe there is an immediate threat to people, property, or health, contact the appropriate emergency or public authority.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WATCHFUL EXTERMINATORS AND ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, SERVICE PROVIDERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE WEBSITE, CONTENT, FORMS, COMMUNICATIONS, LINKS, OR ANY CONTRACTOR OR SERVICE PROVIDER YOU CONTACT THROUGH THE WEBSITE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF WATCHFUL EXTERMINATORS FOR ALL CLAIMS ARISING FROM OR RELATED TO THE WEBSITE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID DIRECTLY TO WATCHFUL EXTERMINATORS FOR ACCESS TO THE WEBSITE DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR ONE HUNDRED U.S. DOLLARS. Some jurisdictions do not allow certain limitations, so some portions may not apply to you.
8. Release
To the maximum extent permitted by law, you release and hold harmless Watchful Exterminators and its owners, officers, employees, agents, affiliates, contractors, service providers, and licensors from claims, demands, losses, damages, liabilities, costs, and expenses arising out of or related to your use of the Website, your communications, your interaction with another user or independent contractor, or work performed by a contractor you contact or hire through the Website.
This release does not waive rights that cannot be waived under applicable law, and it does not prevent a claim based on our own willful misconduct or other liability that applicable law does not permit us to limit.

We may change, suspend, restrict, or discontinue any part of the Website at any time, with or without notice. We may correct typographical, technical, or photographic errors and may update, remove, or add content without a duty to update older material. We may suspend or terminate access if we believe you violated these Terms, created risk, or used the Website unlawfully.

12. Dispute Resolution and Arbitration
Please read this section carefully. Before filing a claim, you and Watchful Exterminators agree to try in good faith to resolve the dispute informally. Send a written notice describing the issue and requested resolution to contact@watchfulexterminators.us. If the dispute is not resolved within 30 days after notice, either party may request individual, binding arbitration, except for the small-claims and intellectual-property exceptions below.
Arbitration will be conducted by a mutually agreed neutral arbitrator under applicable consumer arbitration rules. The hearing may take place remotely or in the county where you live unless the parties agree otherwise. The arbitrator may award the same individual relief available in court, but may not award relief affecting people who are not parties to the arbitration. Each party pays fees as required by the applicable rules, and Watchful Exterminators will pay any fee it is legally required to pay.
You and Watchful Exterminators agree that claims may be brought only in an individual capacity and not as a class, collective, consolidated, or representative action. Either party may bring an eligible matter in small-claims court or seek court relief to protect intellectual property, confidential information, or Website security. To the extent permitted by law, you may opt out of arbitration and the class-action waiver by emailing contact@watchfulexterminators.us within 30 days after first accepting these Terms, stating your name, contact information, and clear decision to opt out. Opting out does not affect the rest of the Agreement.
13. Governing Law and Venue
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles. Subject to the arbitration section, any court proceeding must be brought in a state or federal court serving Arlington, Virginia, and you consent to that court’s jurisdiction and venue. If a court finds a provision unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will remain in effect.
14. General Terms and Contact
These Terms and the Privacy Policy are the entire agreement between you and Watchful Exterminators regarding the Website. A waiver must be in writing. If we do not enforce a provision, that is not a waiver of future enforcement. You may not assign these Terms without our written consent; we may assign them in connection with a business transfer. Headings are for convenience and do not change the meaning of a provision.
